Marketplace Seller Policy

This marketplace seller policy ("Policy") applies to anyone who offers one or more items for sale ("Sellers") in the SoundPedia website shop ("Website Shop" or "Shop").

This policy is part of our Terms of Use. By using SoundPedia, you're agreeing to this policy and our Terms of Use.

Seller basics

As a Seller in the Shop, you acknowledge and agree that:

  1. You are independent and solely responsible for transactions you engage in with Buyers.
  2. You are responsible for all payment processing, shipping, and transaction fees you incur.
  3. You will not attempt to use the Shop to sell to people located outside of your country.
  4. You will not engage in fee avoidance by initiating a sale on the Website and completing the sale on or through another venue or by inflating your shipping prices.
  5. You will respect the intellectual property of others.
  6. You will provide accurate descriptions and photos in your listings.
  7. You will not create duplicate shops, duplicate items, or attempt to coordinate pricing with other sellers.
  8. You will honor your shop policies.

What you can't sell

SoundPedia is geared toward the music industry and its enthusiasts. Items you sell in the Shop should be fit into an existing and appropriate item category. If you think we're missing an item category, please let us know using the contact form.

The following types of items are prohibited from being sold in the Shop:

  • Alcohol, Tobacco, Drugs, Drug Paraphernalia, and Medical Drugs
  • Pornography and Adult Content
  • Dangerous Items: Hazardous Materials, Recalled Items, and Weapons
  • Animal Products and Human Remains
  • Hate Items: Items that Promote, Support, or Glorify Hatred
  • Illegal Items, Items Promoting Illegal Activity, and Highly Regulated Items
  • Violent Items: Items that Promote, Support, or Glorify Violence

Item listings may also be removed if we deem them to be:

  • Defamatory, hateful, threatening, or abusive
  • Obscene, offensive, or vulgar
  • In violation of someone else’s privacy or intellectual property rights
  • Inaccurate, deceptive, or misleading.
SoundPedia will, at its sole discretion, remove any item and/or suspend any account that it considers to be in violation of this policy.

Seller conduct

Ensuring high standards for your shop will set you up for success on SoundPedia. As a seller in the Shop, you agree to:

  1. Promptly respond to inquires from Buyers.
  2. Work with Buyers directly to resolve disputes and ensure customer satisfaction. In the event that you are having trouble resolving an issue with a buyer, we want to know about it. Please let us know about the issue using the contact form. We may, at our sole discretion, attempt to help you resolve the issue.
  3. Promptly cancel and refund orders if you are unable to fulfill them for any reason.
  4. Communicate with buyers in a manner consistent with our Terms of Use.
  5. Not interfere with the sales or operations of any other seller or shop.

Fees for sellers

The following types of fees will be automatically deducted from the total proceeds of any sale you make:

  1. Payment processing fees from your payment processor(s) (e.g. Stripe). Refer to your payment processor's documentation for their current rates.
  2. A platform fee of 5% from SoundPedia. This fee is only applied to the order item total, prior to shipping and taxes.

As a Seller, you are also responsible for shipping costs, refunds, and chargebacks. In the event that you issue a refund using the Website within thirty (30) days of purchase, the SoundPedia platform fee is refundable. You must use the Website's refund functionality in order for the platform fee to be refunded to you. Payment processors have their own policies about refunds and many do not refund payment processing fees when you issue a refund. Please consult the payment processor's documentation for their current refund policies.

Taxes

You are responsible for collecting and paying sales taxes associated with your use of the Shop. The Website provides basic functionality that allows you to define tax rates for specific locations and/or zip/postal codes. We recognize that this functionality may not be sufficient for all Seller use cases. In the event that the tax functionality the Website provides does not allow you to collect the taxes you are required to, you agree to let us know within 7 (seven) days and suspend selling in the Shop immediately. You are responsible for ensuring that you collect and pay all sales taxes that you are legally obligated to collect and pay.

Cancelling orders and returns

In the event that you have to cancel an order for any reason, you must immediately notify the buyer and issue a refund. You can notify the buyer of the cancellation using the Message function on the order in Manage Orders (Manage Page > Sell Merch > Manage Orders). You should also keep proof that you issued a refund in the event that a dispute arises.

Buyers located in European Union (EU) member states may also have the right to cancel and return their purchases within 14 days, for any reason and without a justification. The details of the right to cancel may vary by EU member state. In the event that a buyer exercises this right, you must full reimburse the order and original shipping costs upon receiving the returned item(s) from the buyer. The buyer may be responsible for return shipping costs depending on your shop policy.

Privacy and personal information

As a seller, you may receieve and process names, addresses, and other personal information that your buyers provide to you. You are responsible for protecting buyers’ personal information you receive or process, and you must comply with all relevant legal requirements. Your governing laws may require that you post your own privacy policy. Any privacy policy you post must be compatible with SoundPedia's privacy policy.

This means that as a Seller, you may process personal information (for example, buyer name and shipping address) and, to the extent you do so, under EU law, you are an independent controller of data relating to other users that you may have obtained through the Website Shop. For more information on the General Data Protection Regulation, see more resources at https://gdpr-info.eu and http://gdprandyou.ie. As a data controller (i.e. someone who decides what personal data is collected and the purpose you’ll use the data for) to the extent that you process user personal information outside of the Website Shop, you may be required under applicable data protection and privacy laws to honor requests received from such users for data access, portability, correction, deletion, and objections to processing. Also, if you disclose personal information without the buyer's proper consent, you are responsible for that unauthorized disclosure. This includes, for example, disclosures you make or unintentional data breaches. For example, you may receive a buyer's email address or other information as a result of entering into a transaction with that buyer. This information may only be used for Website Shop communications or for transactions facilitated by the Shop. You may not use this information for unsolicited commercial messages or unauthorized transactions. Without the buyer's consent, and subject to other laws and SoundPedia policies, you may not add any SoundPedia buyer or user to your email or physical mailing list, use that buyer or user's identity for marketing, or obtain or retain any payment information. You are responsible for knowing the standard of consent required in any given instance. If SoundPedia and you are found to be joint data controllers of personal information, and if SoundPedia is sued, fined, or otherwise incurs expenses because of something that you did in your capacity as a joint data controller of buyer personal information, you agree to indemnify SoundPedia for the expenses it occurs in connection with your processing of buyer personal information.
